Pre and Postnupt Agreements
Parties are free to contract regarding the ownership and disposition of their property. They may not, however, waive or forfeit child support.
Like any contract, pre- and postnuptial agreements must be clearly written. They must be voluntarily signed by both parties, and they must indicate that there has been reasonable disclosure of the property or financial obligations of the other party.
While two lawyers are not required, litigation over pre- and postnuptial agreements almost always focuses on whether the terms are clear, whether the agreement was "voluntarily" signed, and whether the disclosure was "reasonable." For this reason we recommend that each party review such agreements with independent counsel.
